Delaware River Basin -- Natural Gas Drilling

Case Law

The following resources present a collection of court filings and judicial opinions regarding the Delaware River Basin Moratorium. Furthermore, it may be necessary to view certain decisions via an online legal research database.

Wayne Land and Mineral Group, LLC v. Delaware River Basin Commission, in the U.S. District Court for the Middle District of Pennsylvania, docket no. 3:16-cv-00897

  • Complaint (Filed May 17, 2016) (Plaintiff claims that DRBC lacks authority under the DRBC Compact to regulate shale, oil, and gas drilling on Plaintiff’s land in the Delaware River Basin)
  • Brief (July 5, 2016) (Delaware Riverkeeper Network filed a brief arguing that it should be allowed to intervene in the lawsuit because if WLMG’s declaratory judgement is granted, it would open the Delaware River Basin to natural gas exploration and would threaten DNR’ environmental interests in the Basin)
